Canadian orders, delivery and terms of sale | FocusPod
These terms govern Canadian FocusPod orders together with the accepted order specification, delivery scope, warranty and returns policy. Keep a copy of each document.
Your seller and contact details
FocusPod is the trading name of Focus Pods Australia Pty Ltd, registered in Australia under ACN 690 612 590 and ABN 73 690 612 590. Configuration and order acceptance
A saved design or delivery estimate is a planning tool. An order identifies the model, quantity, finishes, furniture, options, delivery address, services, total price and agreed schedule. You can review and correct the details before accepting. We send written confirmation and a copy of the agreement that you can retain. A request for a special finish or site service is included only when recorded in the accepted specification. Illustrations and 3D views may show optional items.
CAD prices and payment
Canadian prices are in Canadian dollars. Before payment, the order identifies the supplied goods and services, applicable taxes, delivery, installation and any other mandatory charges. The delivery calculator uses FocusPod estimates and does not itself set a payable charge. We confirm the actual amount and scope you agree to purchase. Any import duties or third-party amounts that cannot reasonably be calculated are described before acceptance. Payment methods and timing are shown with the order; we do not require a method prohibited by applicable consumer law.
Delivery, import and receiving
The accepted order sets out the destination, delivery period, receiving contact, import responsibilities and handling services. Standard estimated freight covers an accessible commercial receiving point with suitable customer-arranged unloading unless another service is expressly included. Tell us about stairs, islands, restricted vehicle access, lift limits or special receiving hours before ordering. We do not add a new service charge without explaining it and obtaining agreement. We remain responsible for delivering what we agree to supply, subject to your applicable legal rights.
Site preparation and installation
Check dimensions, the entire access route, floor suitability, assembly clearances, ventilation and local building requirements before approving the configuration. Installation is included only when specified. Its planning allowance is subject to the agreed scope for labour, access, travel, placement and waste removal. Building alterations, electrical work and specialist lifting are separate unless expressly listed. Use qualified local professionals where required, and follow the product’s installation and safety instructions.
Changes, delays and disputes
We confirm changes to specification, price or schedule in writing. If a delay occurs, we explain the revised timing and available options; your statutory cancellation and refund rights remain. Use the contact details above for a concern, with your order reference and the outcome sought. These terms do not require mandatory arbitration, prevent access to an eligible Canadian court or regulator, or waive a class-action right that the law protects. For Québec consumer contracts, the French version is provided before any lawful express choice of another language.
Mandatory legal rights
These terms add to your rights under applicable Canadian federal, provincial and territorial law. They do not waive or restrict a legal warranty, cancellation right, refund, remedy or right to bring a claim that cannot lawfully be excluded. For Québec consumers, legal warranties include fitness for normal use, reasonable durability and conformity with the description. A legal remedy may remain available after this commercial warranty ends.
